Education and residence Rights of Children of EU Migrant Workers: ECJ Case C-310/08 Ibrahim v Harrow London Borough Council

Regulation 1612/68 on freedom of movement for workers provides that the members of the family of a migrant worker who was a national of one Member State and employed in another Member State had the right to reside with that worker, whatever their nationality (Article 10 of the Regulation). It also provides that the children of such a worker are entitled to attend general educational, apprenticeship and vocational training courses if they are residing in the host Member State (Article 12).

New Judge Appointed to the ECJ

It was commissioned primarily to review the costs of litigation in the light of the changes that have been intiated in the last 20 years to include case management procedures, the current costs regime and so to recommend ways of promoting access to justice.

Note on Mercy Killings

As a result of two recent cases this issue has hit the legal press again in January 2010, when a widow aged 69 who tried to murder her deaf, blind and bedridden mother in a mercy killing was given a suspended prison sentence.

Supreme Court Case-Law Reviewed: Application by Guardian Media and Others v Mohammed Jabar Ahmed [2010] UKSC 1

The case concerned a number of individuals who were the subject of “asset freezing orders” made by the Treasury under various statutory instruments (one applicant was listed on the terrorist watch-list of the Resolution 1267 Sanctions Committee of the UN Security Council, with three others being subject to Section 4 of the Terrorism (United Nations Measures) Order 2006).

Lisbon Treaty and the Court of Justice

The Treaty of Lisbon, which was signed on 13 December 2007 by the 27 Heads of State or Government of the Member States of the Union, came into force on 1 December 2009. It amends the two primary treaties – the Treaty on European Union (TEU) and the Treaty establishing the European Community, with the latter to be known in future as the ‘Treaty on the Functioning of the European Union’ (TFEU).

Supreme Court Case-Law Reviewed: Office of Fair Trading (Respondents) v Abbey National plc & others (Appellants) [2009] UKSC 6

This appeal to the Supreme Court, decided on 25 November 2009, involved a relatively narrow issue, relating to the excessive cost of bank charges imposed by UK banks. While this case is part of an ongoing consumer action against treatment of customers by UK banks, the Court had to decide not whether the banks’ charges for unauthorised overdrafts were fair but whether the Office of Fair Trading (OFT) could launch an investigation into whether they were fair.

Court of Justice Case-law Reviewed: Joined Cases C-402/07 and C-432/07

In a judgment delivered on November 19, the Court of Justice clarified the rights which passengers whose flights are delayed have against airlines by virtue of the Community regulation on compensation and assistance to air passengers.

The United Kingdom’s Supreme Court

2009-10-05

The UK Supreme Court opened on time and apparently on budget in October 2009. It continues the the work currently undertaken by the Appellate Committee of the House of Lords. This move will enhance the independence of the Law Lords and increase the transparency between the top levels of the UK judicial system and Parliament.

Central and European Moot Court Kyiv 2009

The 2009 competition took place during the 1-4th May and was won by the University of Warsaw team; one of whom (Adelina Prokop) also received the Best Speaker award.

This years’ competition was presided over by Eleanor Sharpston Q.C, who is the UK’s Advocate General to the European Court of Justice and a fellow of the University of Cambridge.

Changes due to ‘The 30 year rule’ – a briefing note

In the course of their work government departments and agencies (for example, the Ministry of Defence or the Environment Agency) create many records. Some of these are later preserved for posterity at The National Archives, so that citizens and historians can understand and analyse their government’s actions. Well-known examples of government records include minutes of Cabinet meetings, army service records, statistical reports and policy advice to Ministers.

Prime Minister sets out plans to restore trust in the political system

The Prime Minister has today set out proposals to bring forward urgent legislation to move from the old system of self-regulation of MPs to independent, statutory regulation.

 

It is intended that the creation of a new Parliamentary Standards Authority to regulate the system of allowances and a code of conduct for all MPs will be put before Parliament in a short self-standing Bill before the summer recess. The Parliamentary Standards Authority will regulate and oversee members’ expense claims and oversee the new allowance system. It will also, as was proposed by the Committee on Standards in Public Life, maintain the register of members’ interests and ensure appropriate sanctions are applied in cases of financial irregularity.

England’s first virtual criminal court

2009-05-27

Camberwell Green Magistrates’ Court is the unlikely venue for a new pilot scheme – the so-called Virtual Court.The Virtual Court Scheme is now a daily reality. At Camberwell Green Magistrates’ Court cases can now be heard within hours via a secure video link between Charing Cross police station and the court. The pilot has already seen two cases dealt with in this way. In one case, the hearing took place four hours after the defendant was charged with drink driving. The defendant pleaded guilty and was sentenced, at the end of the hearing, which lasted 20 minutes.

Diploma awards - Prague graduation ceremony

Successful graduates from the BLC courses in Prague and Bratislava were presented with their awards at the ceremony hosted by Dean Milan Damohrskay on Saturday 7th March 2010. The academic director of the course Richard Nolan, St John's College Cambridge, presented students with their diplomas and the event was followed by a reception.

Central and European Moot Court Competition 2010

The 2010 competition will take place between the 30th April to 3rd May 2010 in Sofia, Bulgaria. The competition question and bundle are now available. .

ACADEMIC UPDATES

Keeping up to date with changes in the law or legal advances is extremely important, as a result we have now launched two new ventures and hope that our students/ graduates will play an active part in both.

 

1. The British law centre newsletter 'BLC Obiter Dicta' will first be published in January 2010.  The newsletter will provide the opportunity for the publication of articles on recent events by our students/alumni as well as keeping all subscribers up to date with important changes in law and information as to the BLC events and activities.

 

2. We will be collaborating with Beck (Poland) in their new set of publications of English translations of Polish statutes.
