Barristers’ report snubs solicitors

It has recently been reported in the Law Gazette that a paper published by the Bar Standards Board(BSB), the regulatory body for barristers in England and Wales, contains some opinions that solicitors may find difficult to swallow.

The 2012 Central and Eastern European Moot Competition will take place between the 4th-7th May 2012 in the lovely city of Valetta, Malta and be held in co-operation between the BLC and the Law Faculty, University of Malta.

Warsaw 14th October - Guest lecture of Sir Robert Carnwath ( Senior President of Tribunals) England and Wales

The BLC is very pleased to announce that Sir Robert will be giving an open lecture to all our students, graduates and friends at the Warsaw BLC centre on Friday 14th October at 17.30 in room A2 of the Warsaw law faculty building at ul Lipowa 2/4 entitled:-

" Justice for Users in the UK – New Structures on Old Foundations"

The lecture will look at recent highly significant structural and constitutional changes in the structure of courts in England andWales; in particular the new Supreme Court, the New Commercial Courts and the increasing role of Tribunals.
(Sir Robert Carnwath has long been a supporter of the British Law Centre and has visited Warsaw in that capacity on numerous occasions.)

Legality of the European Central Bank’s Securities Markets Programme under attack

On 14th May 2010, the European Central Bank (ECB) issued a Decision announcing the establishment of its securities markets programme (SMP), which has the aim of helping to bolster the struggling financial markets of EMU member states. Earlier this month, the ECB announced its plans to buy Spanish and Italian government bonds under the SMP in the hope of stimulating interest in these floundering markets.

Human Rights and UK coalition government in Turmoil?

2011-09-01

Since the entry into force of the Human Rights Act 1998, the rights stemming from the European Convention of Human Rights have been directly applicable in the UK and capable of enforcement before the British courts. Until then, the UK had operated on the basis of the doctrine of “residual liberties”, meaning that British citizens were free to do everything that was not prohibited by statute or case-law. The entry into force of the HRA 1998 was heralded as a breakthrough in human rights law, allowing British citizens to be more aware of their rights and enumerating such rights in a clear list that was identical to the ECHR.

ECJ ruling on notary activities

On 24th May 2011 the Court of Justice to the EU found that notary activities was not connected with the exercise of official authority within the meaning of the EC Treaty and that therefore the nationality condition required for access to the profession by the legislation of the six Member States against which the Commission had initiated infringement proceedings, constituted discrimination on grounds of nationality (see e.g. C-47/08 Commission -v- Belgium)

CEEMC Vilnius - Winning Team

2011-05-12

The 2011 competition took place in the lovely city of Vilnius during the 29th April -2nd May 2011 in the presence of Advocate General Sharpston as presiding judge, joined this year by her Lithuanian colleague at the General Court in Luxembourg, Judge Vilenas Vadapalas. This year's winners were from the University of Zagreb with the University of Warsaw as runners up. Congratulations to them all ! The University of Latvia were awarded the prize for Best Written Pleadings. The Slynn of Hadley Best Speaker prize this year (entitling the winner to a short stage at the cabinet of AG Sharpston in Luxembourg) went to Dora Horvat a member of the winning Zagreb team.

European Agency Workers Directive to bring changes in employment conditions

The new “fast-track” copyight tribunal delivers first judgement

On the 3rd May 2011, the new small application, streamlined procedure handed down its first judgement. The case of Archive Media Publishing Limited v MCPS is unlikely to go down in the books of legal history for any other reason, though there are one or two interesting things to note about the decision.

We were particularly pleased to invite Sir Konrad Schiemann to join with our Budapest and Bratislavan graduates this year, when he also gave a talk entitled " Where do we go from here- the challenge for young European Lawyers".

AG’s Opinion Raises New Obstacle to the Envisaged EU Patent

The long and winding road towards a unified EU patent appears to have yet again veered sharply off-course.  On the question of the EU law conformity of a draft international agreement establishing the European and EU Patent Court (EEUPC), Advocate General Kokott responded with a firm “NON!”  The EEUPC lies at the heart of plans envisaging the creation of the long awaited unified EU Patent (or in pre-Lisbon terminology: the Community Patent).

Powers proposed to ban new “legal highs”

The Home Office has announced this month plans to give ministers the power to quickly ban substances taken for “legal highs.” Focus on this issue comes in the wake of the high-profile illegalisation of Mephedrone, a substance marketed online as plant fertiliser but blamed for several deaths connected with its use as a recreational drug.

CEEMC SOFIA 2010

Congratulations to the University of Malta, whose team were hailed champions of the May 2010 Edition of the Central and Eastern European Moot Competition, which was held this year in Sofia, Bulgaria. After an intense final against the University of Riga and in front of the full Court of Justice, the three-man team reigned triumphant in their debut appearance in the competition. 

 

A further congratulations is to be extended to all participants of this year's competition, and an extended welcome to all those who wish to take part in the 2011 Edition of the Competition. Joined Cases C-236/08 to C-238/08 Louis Vuitton v Google

2010-03-25

On the 23rd March, the Grand Chamber of the European Court of Justice delivered its judgement on the legality of allowing registered trademarks to be used by other businesses to promote their own product when users search for the mark on Google search engine. The judgement had two prongs; the first, that the Electronic Commerce Directive (Dir/2000/31) did not impose liability on an “internet referencing service provider” (i.e. Google) for storing data at the request of an advertiser, unless it fails to disable access to that data once it becomes aware of its unlawful nature; and secondly (and more obviously), that the proprietor of a trademark is entitled to prohibit an advertiser from advertising, on the basis of a keyword identical with the advertiser’s trademark, their goods or services which are identical with those of the registered mark.

Education and residence Rights of Children of EU Migrant Workers: ECJ Case C-310/08 Ibrahim v Harrow London Borough Council

2010-03-05

Regulation 1612/68 on freedom of movement for workers provides that the members of the family of a migrant worker who was a national of one Member State and employed in another Member State had the right to reside with that worker, whatever their nationality (Article 10 of the Regulation). It also provides that the children of such a worker are entitled to attend general educational, apprenticeship and vocational training courses if they are residing in the host Member State (Article 12).

New Judge Appointed to the ECJ

It was commissioned primarily to review the costs of litigation in the light of the changes that have been intiated in the last 20 years to include case management procedures, the current costs regime and so to recommend ways of promoting access to justice.

Note on Mercy Killings

As a result of two recent cases this issue has hit the legal press again in January 2010, when a widow aged 69 who tried to murder her deaf, blind and bedridden mother in a mercy killing was given a suspended prison sentence.

Supreme Court Case-Law Reviewed: Application by Guardian Media and Others v Mohammed Jabar Ahmed [2010] UKSC 1

The case concerned a number of individuals who were the subject of “asset freezing orders” made by the Treasury under various statutory instruments (one applicant was listed on the terrorist watch-list of the Resolution 1267 Sanctions Committee of the UN Security Council, with three others being subject to Section 4 of the Terrorism (United Nations Measures) Order 2006).

Lisbon Treaty and the Court of Justice

The Treaty of Lisbon, which was signed on 13 December 2007 by the 27 Heads of State or Government of the Member States of the Union, came into force on 1 December 2009. It amends the two primary treaties – the Treaty on European Union (TEU) and the Treaty establishing the European Community, with the latter to be known in future as the ‘Treaty on the Functioning of the European Union’ (TFEU).

Supreme Court Case-Law Reviewed: Office of Fair Trading (Respondents) v Abbey National plc & others (Appellants) [2009] UKSC 6

This appeal to the Supreme Court, decided on 25 November 2009, involved a relatively narrow issue, relating to the excessive cost of bank charges imposed by UK banks. While this case is part of an ongoing consumer action against treatment of customers by UK banks, the Court had to decide not whether the banks’ charges for unauthorised overdrafts were fair but whether the Office of Fair Trading (OFT) could launch an investigation into whether they were fair.

Court of Justice Case-law Reviewed: Joined Cases C-402/07 and C-432/07

In a judgment delivered on November 19, the Court of Justice clarified the rights which passengers whose flights are delayed have against airlines by virtue of the Community regulation on compensation and assistance to air passengers.

The United Kingdom’s Supreme Court

2009-10-05

The UK Supreme Court opened on time and apparently on budget in October 2009. It continues the the work currently undertaken by the Appellate Committee of the House of Lords. This move will enhance the independence of the Law Lords and increase the transparency between the top levels of the UK judicial system and Parliament.

Central and European Moot Court Kyiv 2009

The 2009 competition took place during the 1-4th May and was won by the University of Warsaw team; one of whom (Adelina Prokop) also received the Best Speaker award.

This years’ competition was presided over by Eleanor Sharpston Q.C, who is the UK’s Advocate General to the European Court of Justice and a fellow of the University of Cambridge.

Changes due to ‘The 30 year rule’ – a briefing note

In the course of their work government departments and agencies (for example, the Ministry of Defence or the Environment Agency) create many records. Some of these are later preserved for posterity at The National Archives, so that citizens and historians can understand and analyse their government’s actions. Well-known examples of government records include minutes of Cabinet meetings, army service records, statistical reports and policy advice to Ministers.

Prime Minister sets out plans to restore trust in the political system

The Prime Minister has today set out proposals to bring forward urgent legislation to move from the old system of self-regulation of MPs to independent, statutory regulation.

 

It is intended that the creation of a new Parliamentary Standards Authority to regulate the system of allowances and a code of conduct for all MPs will be put before Parliament in a short self-standing Bill before the summer recess. The Parliamentary Standards Authority will regulate and oversee members’ expense claims and oversee the new allowance system. It will also, as was proposed by the Committee on Standards in Public Life, maintain the register of members’ interests and ensure appropriate sanctions are applied in cases of financial irregularity.

England’s first virtual criminal court

2009-05-27

Camberwell Green Magistrates’ Court is the unlikely venue for a new pilot scheme – the so-called Virtual Court.The Virtual Court Scheme is now a daily reality. At Camberwell Green Magistrates’ Court cases can now be heard within hours via a secure video link between Charing Cross police station and the court. The pilot has already seen two cases dealt with in this way. In one case, the hearing took place four hours after the defendant was charged with drink driving. The defendant pleaded guilty and was sentenced, at the end of the hearing, which lasted 20 minutes.

Diploma awards - Prague and Warsaw graduation ceremonies

Successful graduates from the BLC courses in Prague and Bratislava were presented with their awards at the ceremony hosted by Dean Milan Damohrskay on Saturday 7th March 2010. The academic director of the course Richard Nolan, St John's College Cambridge, presented students with their diplomas and the event was followed by a reception.

In Poland successful graduates from the Polish centres were presented with their awards in a ceremony hosted by Dean Giaro on Saturday 20th March 2010 in the presence of Prof Cornish (a founder of the BLC) and Lord Justice Carnwath who also gave a talk to students entitled "Constitutional changes in the UK Courts and Tribunals".

ACADEMIC UPDATES

Keeping up to date with changes in the law or legal advances is extremely important, as a result we have now launched two new ventures and hope that our students/ graduates will play an active part in both.

 

 The first edition of the British law centre newsletter 'BLC Obiter Dicta' was published in January 2010, the second edition in May 2010 and the third in January 2011.  The newsletter provides an opportunity for the publication of articles on recent events by our students/alumni as well as keeping all subscribers up to date with important changes in law and information as to the BLC events and activities. The next edition will be published in summer 2011, and we would be interested to hear of any proposed contributions or news to include. Copies of all previous editions of obiter dicta can be found at the following link.
